We live in a complicated world, and it gets even trickier when it comes to divorce financials and negotiations during mediation. On top of all the financial information you need to plan for and be aware of, you can’t deny the layer of overwhelming emotions and anxiety that are inherently part of the divorce process.

So, what exactly is mediation?

It happens. You and your spouse cannot come to an agreement. When this happens, and couples cannot resolve a dispute through talking or negotiating with their lawyers, they may turn (or be court-ordered) to mediation. It’s a short-term, focused conversation facilitated by a mediator and meant to help couples find common ground, identify issues, and create solutions. 

Mediation is one of many methods to avoid litigation using a trained, neutral third party. 

In mediation, both parties come together and meet with a trained mediator, who helps to facilitate a dialogue and negotiation of all the marital issues. During the mediation process, the mediator is neutral and does not represent either party. They are committed to the process, not the people. A mediator cannot tell you whether an offer being made is fair to you or reasonable—all they can do is share with you the general rules concerning the divorce. 

What does the process look like?

While the process will look and feel different for everyone, there are some general stages every mediation typically goes through.

  • You and your spouse select a mediator, decide when you’re going to meet and where, and hopefully, how the mediator will work with you both. 

  • Every mediator has a different approach and style—do you research and look at testimonials and reviews. 

  • The mediator will kick off the session introducing everyone and going over the goals and rules of mediation. 

  • The mediator will meet with both parties and then each spouse (and their attorneys) individually.

  • It will be emotional and can be ineffective if you’re not prepared. The mediator will ask you questions, a lot of them, related to your financial situation and your position on issues to find common ground. 

  • You will be asked on the spot to make decisions and must have the confidence to accept what is being offered or counterproposal.

  • Sessions can last the entire day and may run into the evening. You may need multiple sessions to reach resolution. 

  • When you reach an agreement, the mediator will draft the settlement or memo of understanding.

Again, the mediator isn’t going to decide, or help you decide, any outcomes. They are there to help facilitate the conversation so that you and your spouse can make decisions. That’s why it’s imperative that you assemble a skilled divorce team that can help you ensure both yourself and your family are financially ok post-divorce. The goal is for you to emerge from the process in a position to start your new life out on the best foot possible.

And that means you’re going to have to not only have a deep understanding of the elements and facets of the mediation and divorce process, but you’ll also need the skills and confidence to advocate, make decisive quick decisions, and negotiate for yourself.
